Preparing Evidence for an LTB Hearing

Start with two questions: What is disputed, and which records could help explain it? Organizing early can make your preparation more manageable.

1. Make an inventory

Consider grouping records by issue—for example, the lease, payment records, repair communications or photographs. Create a short timeline connecting events to documents. Keep originals and note where records came from. Relevance depends on the application.

2. Make the materials easy to navigate

The LTB requires legible materials, consecutive page numbers and, for multiple items, an index identifying items and page numbers. Check scans and accepted formats. The hearing member decides whether to accept an item as evidence. LTB evidence direction

3. Distinguish uploading from disclosure to others

Uploading to TOP generally does not provide evidence to another party unless they consented in writing to receive it there and that consent is uploaded. Keep records of delivery. Rule 19.1.1

4. Check deadlines and additional requirements

Rule 19 generally requires evidence at least seven days before a hearing or case management hearing, and responding evidence five days beforehand, unless directed otherwise. Rule 1.12 defines days as calendar days. Verify counting, service and case-specific requirements. Tenants raising other issues at rent-arrears hearings may face additional conditions. LTB Rules
